The terms governing your access to and use of the Together website, including as a supporter contributing to a campaign.

1. About these terms

1.1 What these terms cover

These website terms (Website Terms) govern your access to and use of the Together website at alltogether.giving (the Website). You may access the Website directly or be directed here via a link from a third party, including a Campaign Operator. Either way, by accessing or using the Website, you agree to these Website Terms. If you don't agree, please do not access or use the Website.

These Website Terms should be read alongside our Privacy Policy.

1.2 About us

The Website is operated by Together Giving Pty Ltd (ABN 69 696 704 604) (Together, we, us, our).

When we refer to you or your in these Website Terms, we mean anyone who accesses or uses the Website.

1.3 About you

By accessing the Website, including creating an account or engaging with any Campaign Operator through it (including by making any contributions), you confirm that you are aged 18 or over, or that you have the consent of a parent or guardian. You also confirm that your use of the Website is lawful in the jurisdiction you are accessing it from.

2. Together is a platform - not a campaign

2.1 Platform only

Together provides a technology platform that enables organisations (each a Campaign Operator) to create and manage fundraising and advocacy campaigns and to receive contributions from supporters (Supporters) through the Website. We are not a Campaign Operator and we do not run, endorse, manage or otherwise participate in any Campaign Operator or campaign on the Website.

2.2 No responsibility for campaigns

While we take reasonable steps to verify Campaign Operators, to the extent permitted by law, we do not control, endorse, verify or take responsibility for:

  • the accuracy or completeness of any content, representations or claims made by or on behalf of a Campaign Operator or their campaigns;
  • the lawfulness, legitimacy or use of funds raised by any Campaign Operator including via the Website;
  • whether a Campaign Operator is registered, licensed or otherwise entitled to solicit donations or contributions in any jurisdiction; or
  • a Campaign Operator's compliance with applicable laws, including electoral laws, charitable fundraising laws and taxation laws.

2.3 Your due diligence

Before engaging with any Campaign Operator, including making any donation or contribution through the Website, you should satisfy yourself that the Campaign Operator and the campaign are legitimate and that you understand how your funds will be used. We encourage you to review the Campaign Operator's own terms and policies, including their privacy policy, before contributing. This applies equally where a Campaign Operator recommends another Campaign Operator or campaign to you. Any such recommendation is for information only, the decision to contribute remains entirely yours, and we do not endorse any recommendation made through the Platform.

3. Accounts

3.1 Creating a Supporter account

As an individual wishing to engage with or contribute to Campaign Operator campaigns on the Website, you may create a Supporter account by registering on the Website. If and when you do, you must provide accurate and complete information and keep your account details up to date. 3.2 Account security

You are responsible for:

  • keeping your login credentials confidential;
  • all activity that occurs on your account; and
  • notifying us immediately at hello@alltogether.giving if you suspect any unauthorised access to your account.

4. Transactions

4.1 Payment processing

All transactions through the Website are processed by a third-party payment processor (we currently use Stripe). We facilitate the transmission of your contribution to the Campaign Operator or Campaign Operators to whom your contribution is directed, in accordance with your instructions. We do not hold or deal with funds beyond what is strictly necessary for that transmission.

4.2 Your contribution is to the Campaign Operator

Subject to clause 4.3 below, when you make a contribution through the Website, your funds are transmitted to the Campaign Operator or Campaign Operators to whom your contribution is directed. Together does not control or manage how Campaign Operators use the funds they receive. You are responsible for satisfying yourself as to the legitimacy of the Campaign Operator and the purpose of the campaign before contributing.

4.3 Transaction fees

When you make a contribution through the Website, platform fees (charged by us) and payment processing fees (charged by our third-party payment processor) may be deducted from the amount you pay. This means the Campaign Operator may receive less than your total contribution. The Campaign Operator is aware of this and agrees to it as part of their subscription with us.

4.4 Refunds

Each Campaign Operator sets their own refund policy for contributions received through the Website. Please refer to our Refund Policy for information on how refund requests are handled, including how to contact us if you cannot reach the Campaign Operator directly.

4.5 Tax and related matters

Whether any contribution you make is tax-deductible depends on the Campaign Operator and the nature of the campaign. We do not make any representations about the tax treatment of any donation or contribution, and you should obtain your own professional advice. If you need official documentation of your contribution for tax reasons, please contact the Campaign Operator directly.

5. Acceptable use

5.1 General

You must use the Website only for its intended purposes and in compliance with all applicable laws, codes and regulations.

5.2 What you must do

You must only upload or input data and content that:

  • you have the rights and consents to upload;
  • does not infringe anyone else's rights, including privacy rights and intellectual property rights;
  • is not unlawful, fraudulent, misleading, offensive, defamatory, discriminatory or harassing; and
  • does not contain malicious code, viruses or harmful software.

5.3 What you must not do

You must not:

  • access (or attempt to access) parts of the Website you are not authorised to;
  • test or probe our systems for vulnerabilities, attempt to bypass any security mechanism, or place unreasonable burdens on our systems;
  • copy, disassemble, decompile, reverse-engineer or modify any part of the Website, or use automated tools to extract information from it;
  • impersonate any person or organisation, including using another person's login details without their permission;
  • use the Website to solicit, accept or process funds connected with illegal activity, the financing of terrorism or violent extremism, money laundering, fraud or deceptive solicitation, unlicensed money transmission, or the sale of regulated or prohibited goods including weapons, controlled substances or adult content;
  • use the Website for any activity prohibited by our payment partners, including the Stripe Restricted Businesses list; and/or
  • do anything else that would undermine the integrity or security of the Website.

5.4 Sanctions and prohibited jurisdictions

You must not use the Website to make or facilitate a contribution if you are located in, ordinarily resident in, or established in Cuba, Iran, North Korea, Syria, or the Crimea, Donetsk or Luhansk regions of Ukraine, or that is the subject of, or owned or controlled by a person subject to, sanctions administered by the Australian Government (DFAT Consolidated List), the United Nations Security Council, or, where applicable, the United States (OFAC), the United Kingdom (OFSI) or the European Union. You must not contribute to any Campaign Operator or campaign that you know or reasonably suspect to be located in, or connected with, any of the above jurisdictions or sanctioned persons. We and our payment partners screen accounts and transactions against applicable sanctions lists and may decline, hold or reverse any transaction, and suspend or close any account, to comply with sanctions law.

5.5 No raffles, lotteries or gambling

The Website may not be used to conduct, promote or process payments for raffles, lotteries, sweepstakes, prize draws, gaming, wagering or any other form of gambling, whether or not conducted for a charitable purpose. Transactions processed through the Website must be voluntary gifts that do not entitle the contributor to a chance to win a prize or receive any other benefit.

5.6 Breach of this clause

If you breach this clause, we may suspend your access and/or remove non-compliant content immediately and without liability to you. We will try to notify you before doing so, or as soon as practicable after. If you remedy the breach, we will reinstate your access.

6. Intellectual property

6.1 Our intellectual property

All intellectual property rights in the Website and its content (including text, graphics, data, photographs, trade marks, trade names, logos, icons, layouts, sound recordings and software) are owned by or licensed to us. These Website Terms do not transfer any intellectual property rights to you or any third party.

6.2 Permitted use

You may access and view content on the Website for personal, non-commercial purposes. Without our prior written consent, you must not:

  • reproduce, store, distribute, adapt, modify, publish or create derivative works from any part of the Website or its content;
  • scrape, data mine, harvest or index Website content;
  • train large language models or AI systems on any material from the Website; or
  • use any automated tools, scraping technologies or similar to copy or extract information from the Website.

7. Our Privacy Policy

Our Privacy Policy explains how we collect, use, store and handle your personal information, including in connection with contributions made via our Website. It forms part of these Website Terms. By using the Website, you consent to the collection and handling of your personal information as described in the Privacy Policy.

8. Third party links

Our Website may include links to third-party websites, materials, products or services. We do not control, endorse or verify any third-party content. We make no representations or warranties in relation to third-party websites, products or services, and we exclude all liability arising from your access to or use of them.

9. Liability

9.1 General disclaimer

This clause applies to the fullest extent permitted by law. It does not operate to exclude or limit any rights you have, or any liability we cannot exclude or limit, under applicable laws, codes or regulations, including the Australian Consumer Law. Where the Australian Consumer Law permits us to limit our liability, we limit it to the greatest extent permitted.

9.2 Website provided as-is

Your use of the Website is at your own risk. The information on the Website is general in nature, may change over time, and we do not guarantee that it is accurate, complete, current or error-free. This includes content created or posted by Campaign Operators, which we do not verify or endorse. The Website and its content are provided "as is" and "as available", without any express or implied warranties, including that the Website or its operation will be secure, confidential, uninterrupted or error-free.

9.3 Exclusion of liability

To the extent permitted by law, we exclude all liability for any loss or damage (including indirect or consequential loss, loss of opportunity, economic loss or business interruption) arising from:

  • your use of, or inability to use, the Website;
  • your reliance on any content on the Website;
  • any contribution you make through the Website; or
  • any act or omission of any Campaign Operator.

10. Suspension and termination

We may suspend or close any account you have with us at any time by notice to you. We may also suspend or terminate your access to the Website or any part of it at any time, including if we discontinue our platform. We will try to give you reasonable notice where practicable. Any accrued rights survive termination.

11. Changes to these Website Terms

We may update these Website Terms from time to time. The date at the top of this page reflects when they were last updated. We encourage you to check back periodically. Your continued use of the Website following any update constitutes your acceptance of the revised Website Terms.

12. General

12.1 Governing law

These Website Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of that State.

12.2 Severance

If any part of these Website Terms is held to be invalid or unenforceable, that part is severed and the rest continues to apply.

12.3 No waiver

If we do not enforce a right under these Website Terms, that does not mean we have waived it. Any waiver must be in writing and applies only to the specific right or breach being waived.

12.4 Entire agreement

These Website Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your access to and use of the Website. They supersede all prior discussions, representations and agreements on this subject.
